The primary battle between Mehmet Oz and David McCormick continues in the courts while recounts of the results are taking place across the Commonwealth of Pennsylvania and has reached the Supreme Court of the United States. Within hours of the start of a commonwealth court case about allowing a count of 850 mail-in ballots without dates on the envelope, Supreme Court Justice Samuel Alito issued a hold on a federal order key to that decision. McCormick campaign attorneys planned to argue that a 2020 decision by a Federal Appeals Court to allow otherwise complete ballots without a date on the envelope to be counted, but with Justice Alito’s stay on the decision could put the legal argument in jeopardy.
